Official Rules
ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
1. Eligibility. Subject to the additional restrictions below, the Pet of the Year Contest is open to residents of the United States (excluding Puerto Rico), 18 years or older at the time of entry. Employees of The Tennessee Newspaper In Education Group, Inc., The Tennessean, The Daily News Journal, The Leaf-Chronicle, Gannett Co., Inc and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win.
2. Contest Period. Contest begins at 12:01 a.m. (C.D.T.) on September 8, 2009 and ends at 11:59 p.m. (C.D.T.) on November 22, 2009.
3. How to Enter. Beginning at 12:01 a.m. (C.D.T.) on September 8, 2009 and ending at 11:59 p.m., (C.D.T.) on September 27, 2009, enter by submitting an Entry Form and a photo of your pet with all required information and requested $15.00 donation (cash, check, money order of credit card) to The Tennessee Newspaper In Education Group. The pet owner’s name and phone number must be included with all entries. Entries must be submitted by the pet’s owner who must be 18 years or older. Only one photo per pet per entry please and no more than [5] of entries per person. One picture of any number of pets is considered one entry. If you want to enter more than one pet individually a separate entry form must be submitted and accompany each picture. Sponsor reserves the right to refuse any photograph it determines to be unacceptable. Entries with incomplete or incorrect information will not be accepted. Photos must be a minimum of 3”x 5” in size. Digital photos must be at least 4” wide and have a resolution of at least 300 dpi. Most digital pictures taken in the mid to high quality camera setting will be fine. Poor quality photos will not be accepted. All photos become property of Sponsor and will not be returned. Copyrighted photos must be accompanied by a photographer’s release. Submitting the photo and an entry form serves as a release for the Sponsor and The Tennessean, The Daily News Journal, and The Leaf-Chronicle to use the pet‘s name and photo in connection with promotion of the Contest in The Tennessean, The Daily News Journal, and The Leaf-Chronicle and on its website. Donation checks should be made payable to The Tennessee Newspaper In Education Group.
Online Entry: Complete the entry form at www.nieonline.com/tennessee, upload photo, submit form of donation, complete any other required fields and then submit your entry by clicking on the “SUBMIT” button. Online entries must be received by 11:59 p.m. on September 27, 2009. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. By entering, you agree to the terms of these Official Rules and to receive e-mails from the sponsor or those directed by sponsor. You can opt out of the receipt of emails by following the directions on the contest website or in email received from sponsor.
Mail or In Person Entry: Complete the Entry Form found in The Tennessean, The Daily News Journal, and The Leaf-Chronicle, as space allows, during the Entry Period and also available at The Tennessean main lobby at 1100 Broadway, Nashville, TN, during regular business hours, The Daily News Journal main lobby at 224 N. Walnut Street, Murfreesboro, TN during regular business hours, and The Leaf-Chronicle main lobby at 200 Commerce Street, Clarksville, TN during regular business hours. The entry form with the photo and suggested donation can be mailed or delivered to Pet of the Year Contest, Tennessee Newspaper In Education Group, PO BOX 330610, Nashville, TN 37203 or dropped off in the lobby of The Tennessean, The Daily News Journal, or The Leaf-Chronicle, Mon. – Fri. from 8 a.m. to 5 p.m. In Person entries must be received by 5:00 p.m. September 27, 2009. Mailed entries must be postmarked by September 27, 2009, and received no later than September 29, 2009.
Sponsor will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries or votes by persons determined to be tampering with or abusing any aspect of the contest.
4. Voting Procedures and Winner Selection. Voting for your favorite pet will be held in Three Rounds beginning at 12:01 a.m. (C.D.T) on October 5, 2009, and end at 11:59 p.m. (C.D.T.) on November 22, 2009. Voting is open to the general public. Online voting is limited to persons 13 years and older. Your computer must accept cookies or any successor or similar technology, which may be used for the purpose of entry tracking. All blocking software on your computer needs to be disabled so that it doesn’t interfere with processing of your entry. No refunds of donations will be provided.
Online Voting: To vote, go to www.nieonline.com/tennessee and submit a vote with a suggested $1 donation with each vote. (A $5.00 online donation counts as 5 votes.) There is no limit on donation amounts. All donations submitted by check must be made payable to The Tennessee Newspaper In Education Group. All online votes must be submitted no later than 11:59 p.m. on November 22, 2009.
Mail or In Person Voting: Original ballots and donation can be mailed to Pet of The Year Contest, The Tennessee Newspaper In Education Group, PO BOX 330610, Nashville, TN 37203 or dropped off in the lobby of The Tennessean, The Daily News Journal or The Leaf-Chronicle, Mon. – Fri. from 8 a.m. to 5 p.m. In Person entries must be received by 5:00 p.m. on November 22, 2009. Mailed entries must be postmarked by November 22, 2009, and received no later than November 24, 2009.
You can vote without making a donation by submitting an original ballot (no photocopies allowed). Only one original ballot per person, per envelope, per day will be accepted. Sponsor will not accept more than [42] Original Ballots from one person nor more than [42] Original Ballots in one day from any individual. Original ballots are in The Tennessean, The Daily News Journal, and The Leaf-Chronicle, as space permits, and are available to be picked up at The Tennessean, The Daily News Journal, or The Leaf-Chronicle lobby, Mon. – Fri. from 8 a.m. to 5 p.m.
Elimination Rounds. The voting period will consist of three (3) rounds. Contestants with the lowest votes in each round will be eliminated from the contest. The contestants with the highest votes will continue to the next round. All votes must be submitted within the date and times list below. All times are Eastern Daylight Time. Votes are not consecutive. Voting starts over with each round.
Round One: Round One will commence on October 5, 2009, and will consist of all the pets entered in the Contest. All votes for the first round must be submitted by 11:59 p.m. on October 18, 2009. The fifty (50) pets receiving the highest amount of eligible votes will advance to Round Two. Round One winners/Round Two qualifiers will be announced online at www.nieonline.com/tennessee on October 22, 2009.
Round Two: Round Two will commence on October 22, 2009, and end at 11:59 p.m. on November 4, 2009. The twenty five (25) pets receiving the highest amount of eligible votes will advance to Round Three. Round Two winners/Round Three qualifiers will be announced online on November 9, 2009.
Round Three: Round Three will commence on November 9, 2009 and end at 11:59 p.m. on November 22, 2009. The entry with the highest number of eligible votes at the end of this Round will be the First Prize Winner. The next eleven entries with the highest number of eligible votes will be the Runner Up Winners. In the event of a tie, Sponsor will randomly pick the winner from the tied entries. Winners will be announced on or around November 29, 2009.
5. Prizes and Odds. One (1) First Prize Winner will be featured on the cover and on one (1) month of the 2010 Pet of the Year calendar to be produced by The Tennessee Newspaper In Education Group. Eleven (11) Second Prize Winners will be featured one per month in the 2919 Pet of the Year calendar to be produced by The Tennessee Newspaper In Education Group.
6. Winner Notification and Acceptance. Winners will be notified on or about November 25, 2009 at the telephone number and/or email address provided on winner’s entry form. Sponsor will call during regular business hours at number provided on entry form. Failure to reach winner by phone or email or failure to claim prize may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. To claim prize, pets and their owners must be available on the dates selected by the photographer to be photographed or risk not being included in the calendar. Valid photo identification may be required. Winner may waive his/her right to receive the prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law) which must be returned as instructed by Sponsor. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Prizes won by minors will be awarded to parent or legal guardian who must sign any affidavit or release required by Sponsor. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by Sponsor. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Pet Idol Contest. Should the contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Sponsors will not be responsible for incomplete, lost, late, misdirected or illegible entries (either photos or ballots), poor quality photos, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. 8. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
9. Sponsor. The Pet of the Year Contest is sponsored by The Tennessee Newspaper In Education Group. (a 501(c)(3) non-profit organization), and donations collected will benefit The Tennessean, The Daily News Journal and The Leaf-Chronicle’s Newspaper in Education program (NIE). The decisions of Sponsor regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest.
