BABY OF THE YEAR CONTEST OFFICIAL RULES


ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility: Subject to the additional restrictions below, the Baby of the Year contest (the “Contest”) is open to parents who are U.S. residents (excluding Puerto Rico), 18 years or older at the time of entry. Employees of The Tennessean, The Tennessee Newspaper In Education Group (“Sponsor”), Gannett Co., Inc., and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win.

2. Contest Period: Contest begins at 12:01 a.m. (C.D.T) on Monday, May 24, 2010 and ends at 11:59 p.m. (C.D.T.) Wednesday, September 15, 2010.

3. How to Enter. Beginning at 12:01 a.m. (C.D.T.) on May 24, 2010 and ending at 11:59 p.m. (C.D.T.) on July 7, 2010 (“Entry Period”), enter by submitting a photo of your baby along with a completed entry form, all required information and suggested $15 donation. Checks should be written to The Tennessee Newspaper In Education Group. Photos must be submitted by the parent(s) or legal guardian who must be 18 years or older. The babies entered must be no older than 3 years old as of December 31, 2010. Sponsor reserves the right to verify proof of age. Only one photo per entry per baby. One picture of any number of babies is considered one entry. If you want to enter more than one baby individually, a separate entry form must be submitted and accompany each picture. Each entrant may submit more than one baby but each baby may be entered only once. No adults or children older than the eligibility age should appear in the photo. The parent or legal guardian’s names and phone numbers must be included with all entries as well as written on the back of each photo. Entries with incomplete or incorrect information will not be accepted. Photo should be 3”x5” wide or larger and digital photos should be in jpg or tif format and 200 dpi resolution. Most digital pictures taken in the mid-to-high quality camera setting will be fine. Poor quality photos of either type will not be accepted. Parent/guardian information will be verified by phone. Photos will not be posted until information is verified. Submitting this information, the photo and an entry form serves as a release for Sponsor and The Tennessean to use your baby’s name, first initial of last name and photo in The Tennessean and on its web site. All photos become property of Sponsor and The Tennessean and will not be returned. If a professional and/or copyrighted photos must be accompanied by a photographer’s release. Sponsor reserves the right to refuse any photograph it determines to be unacceptable.

Online Entry. Enter online by visiting Baby of the Year registration page at www.tennessean.com/baby. Complete the entry form, attach the photo, and complete any other required fields. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Online submissions must be received by 11:59 p.m., July 7, 2010. By entering, you agree to the terms of these Official Rules and to receive e-mails from Sponsor or those directed by Sponsor. You can opt-out of the receipt of such e-mails by following the directions on the contest website or in any email received from Sponsor.

Mail or In-Person Entry. To enter by mail or in-person, complete an Official Entry Form available at The Tennessean offices located at 1100 Broadway, Nashville, TN 37203 or in The Tennessean during the Entry Period. The entry form with the photo can be mailed to The Tennessean/Baby of the Year Contest, P.O. Box 330609, Nashville, TN 37203 or dropped off in the lobby of The Tennessean, Monday through Friday between 8:00 a.m. and 5:00 p.m. Checks should be written to The Tennessee Newspaper In Education Group. All mailed entries must be postmarked no later than July 7, 2010 and received no later than July 12, 2010. All in-person entries must be submitted by 5:00 p.m. on Wednesday, July 7, 2010.
Photocopies of the entry form are permitted. The Tennessean will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries. The Tennessean reserves the right to disqualify any entries or votes by persons determined to be tampering with or abusing any aspect of the contest. In the event of a dispute, all online entries and/or votes will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account.

4. Voting Procedures and Rules. Vote for your favorite baby by going to www.tennessean.com/baby. All photos will be displayed online at www.tennessean.com/baby on or about May 24, 2010. Updates will be made as entries are received through the deadline of July 7, 2010. Votes may be made in person, mailed or submitted online. Votes can be placed without a donation using an original voting ballot. Original voting ballots are available in The Tennessean and over the counter at The Tennessean, 1100 Broadway, Nashville, TN 37203. Mailed votes must be postmarked in time to be received within the required voting period(s). Voting is open to the general public, who meet the residency requirements stated above. There are three ways to vote:

Online at www.tennessean.com/baby. Online voting is limited to persons 13 years of age or older. Vote for your favorite baby by submitting a vote along with a suggested $1.00 donation to The Tennessee Newspaper In Education Group. Each $1.00 that is donated will count as one vote. When voting online, the minimum suggested donation is $5.00. There is no limit on donation amounts. Votes can be placed without a donation using an original voting ballot available in The Tennessean or at The Tennessean offices. Votes must be received within the dates of the elimination rounds to qualify.

Mail votes with voting form available online and published in The Tennessean during the voting period. Mailed votes should be addressed to: The Tennessean/Baby of the Year Contest, P.O. Box 330609, Nashville, TN 37203. Checks should be written to The Tennessee Newspaper In Education Group. Mailed votes must be received within the dates of the elimination rounds to qualify. Each ballot submitted without a donation is counted as one vote and is limited to one vote per form per addressed envelope per day. Donations can be included with a mailed ballot and will count as one vote for each $1.00 donated. The Tennessean will not be responsible for mail that is incomplete, lost, late, postage-due, misdirected or illegible.

In person votes can be made at The Tennessean offices located at 1100 Broadway, Nashville, TN 37203 during office hours only - Monday - Friday, 8:00 a.m. – 5:00 p.m. Each ballot submitted without a donation is counted as one vote and is limited to one vote per form, per person, per day. Donations can be included with in-person votes and will count as one vote for each $1.00 donated. Checks should be written to The Tennessee Newspaper In Education Group.
Elimination Rounds – The voting period will consist of two (2) rounds. Contestants with the lowest votes in each round will be eliminated from the contest. The contestants with the highest votes will continue to the next round. All votes must be submitted within the date and times list below. All times indicated are Central Daylight Time. Votes are not consecutive. Voting starts over with each round.

Round one – Includes all babies entered in the contest. Voting will begin at 12:01 a.m. on Wednesday, July 14, 2010 and end at 11:59 p.m. on Wednesday, August 11, 2010. Mailed votes must be postmarked by August 11, 2010 and received no later than Monday, August 16, 2010. In person votes must be received by 5:00 p.m. Wednesday August 11, 2010. The Fifty (50) babies receiving the most votes will move on to Round Two and will be published online at www.tennessean.com/baby on Wednesday, August 18, 2010.

Round two – The top 50 babies receiving the most votes in Round One. Voting will begin when results are posted on Wednesday, August 18, 2010 and end 11:59 pm on Wednesday, September 15, 2010. Mailed votes must be postmarked by Wednesday, September 15, 2010 and received no later than Monday, September 20, 2010. In person votes must be received by 5:00 p.m. on Wednesday, September 15, 2010.

5. Winner Selection. One (1) Grand Prize Winner and Eleven (11) First Prize Winners will be selected. Winners will be determined by total number of votes received. The Grand Prize Winner will be the baby with the most votes and the eleven (11) babies receiving the next highest numbers of votes will be the First Prize Winners. In the event of a tie, Sponsor will randomly pick the winners from the tied entries. Winners will be selected on or about September 20, 2010.

6. Prizes and Odds One. (1) Grand Prize Winner will be featured on the cover and one month of the 12 month 2011 Baby of the Year Calendar to be produced by The Tennessean, Eleven (11) First Prize Winners will be featured one per month in the 2011 Baby of the Year Calendar. All winners must be available early September through early October for photos to be included in the calendar or risk not being included in the calendar. Photos in the calendar will be picked by the photographer and The Tennessean at their sole discretion. Odds of winning depend on the number of eligible entrants and eligible votes received.

7. Winner Notification and Acceptance. Winners will be notified at the telephone number or email address provided on the winner’s entry form. Calls will be made during regular business hours. Three (3) attempts will be made to reach winners, however, failure to reach winner by phone or email, may result in disqualification of winner, and selection of a substitute winner from among all remaining eligible entries. Parent(s) and their baby must be available on the dates selected by the photographer and The Tennessean to be photographed for the calendar or risk not being included in the calendar. Winner(s) will be required to present valid photo identification and sign an affidavit of eligibility/liability and publicity release. Failure to sign the release or to comply with any term or condition of these Official Rules may result in a winner’s disqualification, and the announcement of a substitute winner. Except where prohibited, acceptance constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation.

8. Participation. By participating, entrants agree to be bound by these Official Rules. Sponsor and The Tennessean reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by Sponsor. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond which corrupts or impairs the administration, security, fairness or proper operation of the contest, Sponsor and The Tennessean reserves the right in its sole discretion to suspend, modify or terminate the contest. Should the contest be terminated prior to the final round, Sponsor The Tennessean reserves the right to designate winning pets based on the ballots received before the termination date.

9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

10. Sponsor. The Baby of the Year Contest is sponsored by The Tennessee Newspaper In Education Group for the benefit of The Tennessean Newspaper in Education Program. The decisions of Sponsor and The Tennessean regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. Sponsor and The Tennessean will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest.
